The holder of all rights to the sugarfactory.hr website is the trading company Consortium Ltd. Through the said website, it provides a sales service through its sugarfactory.hr webshop service. By using the sugarfactory.hr webshop service and all associated pages and services on the sugarfactory.hr domain, consumers are deemed to be familiar with these Terms of Sale (hereinafter: Terms) at all times and fully understand and accept them. These Terms apply to the rights and obligations related to the purchase of products or services through the sugarfactory.hr webshop and the rights and obligations arising from the conclusion of a distance selling contract (hereinafter: Contract) between the consumer as the end buyer and the sugarfactory.hr webshop, and are deemed to be an integral part of such contracts.

Users are advised to familiarize themselves with these Terms before making a purchase and to regularly check them to be informed of all their rights and obligations.

Consortium Ltd. reserves the right to amend these Terms at any time without prior notice, and shall not be liable for any possible consequences arising from such changes. These changes come into effect upon publication on these web pages.

The use of the sugarfactory.hr webshop services is granted exclusively to adults. The use of the sugarfactory.hr webshop by children or minors is not permitted, and parents and/or guardians are obliged to ensure this, otherwise, they assume all rights and obligations arising from such use, and Consortium Ltd. shall not be liable for any consequences of such use.

The sugarfactory.hr webshop fully disclaims any responsibility for the accuracy and/or completeness of all information and content found on sugarfactory.hr. The sugarfactory.hr webshop reserves the right to errors in the description and image of products.

Product images on the sugarfactory.hr web shop are for illustrative purposes only. The image illustrating the product on the sugarfactory.hr website may not fully correspond to the actual appearance and content of the product, and the buyer cannot complain about such products on that basis. Sugarfactory.hr Shop will strive to publish accurate and up-to-date information on the sugarfactory.hr website, but assumes no responsibility for the accuracy and completeness thereof.


I) Conclusion and termination of the sales contract
These Terms as well as individual sales conditions indicated with information about specific products represent an offer by Consortium Ltd. to conclude a Contract, and the user as the buyer by placing an order or in another way determined by these Terms accepts them, thereby concluding a Contract between the user and Consortium Ltd., according to the sales terms specified in these Terms.

The subject matter and commercial purpose of the Contract is the purchase of the selected product or service through the sugarfactory.hr webshop with payment of the corresponding fee – the price of that product or service. The Contract is concluded by means of distance communication (Distance Contract) via: printed promotional messages with an order form, telephone with or without human intervention, and the Internet.

The Contract comes into effect and becomes binding from the moment the user accepts the offer of Consortium Ltd. in one of the following ways:
• by choosing the payment method and completing the order through the sugarfactory.hr webshop.
• by choosing the payment method and completing the order by calling the telephone line +385 (0)31 575557.

II) Terms and procedure of purchase
The main characteristics of the product, the method of use, prices, special promotions, and benefits, methods of payment, and delivery relate to those valid at the time of concluding the order. These data will be indicated alongside each product.
The price of the product, including the amount of VAT and delivery costs, is visible in the shopping cart before completing the order. The cost of delivery may also be visible in some other parts of the website. All information on purchase confirmation based on electronic orders will be sent to the email address of the buyer provided in the registration/order process or in the shopping cart when entering data during order completion. All prices are expressed in Euros (€). VAT is included in all prices.

If the buyer does not receive a confirmation email, there is a possibility that he/she entered the email address incorrectly. In that case, the buyer is kindly requested to contact us at: info@sugarfactory.hr or by phone at +385 (0)31 575557 so that our customer service can verify whether the order has been received. III) Delivery and delivery terms
• the cost of delivery is automatically calculated when purchasing the product, and you will be issued an invoice showing the price of the purchased products and the delivery cost
• the cost of delivery will be indicated in the shopping cart alongside the price of the product
• the cost of delivery in the territory of the Republic of Croatia is fixed and amounts to 3,98 € regardless of the weight, volume, or address of the buyer
• for orders above 70.00 €, the entire delivery cost is borne by sugarfactory.hr webshop.
• for items where the price is not indicated or it says "send inquiry," the free delivery above 70.00 € does not apply, but a special delivery calculation is made
• the delivery time of products indicated to be in stock throughout Croatia is 5 to 7 working days from the date of the concluded order, except for products with a special note (non-stock item)
• the delivery time of products indicated to be in stock to Croatian islands is 7 to 10 working days
• in case of a change in the delivery time or any other important circumstances for the execution of the order, our customer service will immediately notify the buyer
• in case of incorrectly ordered product by the buyer, the postage cost is borne by the buyer

IV) Complaints and objections
Ordered products are packaged in such a way that they are not damaged by normal handling during transport/delivery. The buyer is obliged to inspect the package of the shipment upon receipt. If the package of the shipment has visible damages/defects, we recommend that the buyer refuses to accept it because there is a possibility that the product inside such packaging is damaged. By refusing to accept it, the delivery service will return the shipment to Consortium, with a note that the shipment contains a defect.

In the case of a justified complaint, the contract can be terminated with a refund of the paid amount or product replacement. The buyer has the right to unilaterally terminate the contract within 14 days without stating a reason. If it is an issue of damage and/or defectiveness of the delivered goods, the buyer should send a photograph of the mentioned complaint for it to be considered based on physical evidence. Consortium collects the complained about damaged, defective, or incorrectly delivered goods at its own expense if it is found that the complaint is justified and that the buyer did not influence the defect, damage, or any deficiency of the goods. In the case of a justified complaint, the cost of replacing the product with a new one is entirely borne by Consortium.

In the case of a dispute regarding the justification of the complaint and/or the manner in which the product was returned (the product must be unused, in the original quantity, and in the original packaging, with the original invoice and warranty, if any) the product will be sent for expert examination to an expert or legal entity. In case the examination determines the validity of the complaint, all costs of replacing the product are borne by Consortium, and in the case of an unjustified complaint, the cost will be borne by the buyer.

In the case of incorrectly ordered products, the buyer has the right to return the product at his/her own expense within 14 days, and the refund of the paid amount will be made to the buyer's current account or card only after Consortium receives the returned product. We will make the payment in the same way the payment was made, unless the buyer explicitly agrees to another method of payment and assuming Consortium is not obliged to pay any additional costs for such refund. The cost of returning the goods due to unilateral contract termination by the Buyer is borne by the Buyer.

When requesting liability for material defects, we will act in accordance with the provisions regulated by Articles 400 to 422 of the Obligations Act ("Narodne novine", numbers: 35/05., 41/08.1, 125/11).

V) Warranty for the correctness of sold products and service
Products for which we provide a warranty in accordance with the law and a warranty specified by the manufacturer have a warranty certificate. The right to use the warranty is exercised by presenting the invoice and warranty certificate. The buyer is obliged to keep the warranty certificate and the invoice. The date of issue of the invoice is the date of activation of the warranty. Alongside the product description, information is provided about the period for which the warranty for the specific product is guaranteed.
In the case of issuing a warranty certificate with which the manufacturer guarantees the correctness of the product within a certain period, the buyer may, if the product is not correct, demand that the product be repaired within a reasonable time, or that another such correct product be handed over to him/her instead of the repair. If a product becomes defective during the warranty period, it is delivered to the authorized service specified in the warranty certificate.
The right to use the warranty is exercised solely by presenting the invoice. The buyer is obliged to keep the warranty certificate and the invoice. The product's defectiveness resulting from improper use and/or failure to follow the instructions is not covered by the warranty. Servicing and sale of replacement parts for the purchased product are provided by authorized service providers specified in the warranty certificate.

VI) Method and procedure of payment
The price of the product and delivery costs can be paid in one of the following ways:

a) Payment by credit or debit card. Ordered products can be paid online with one of these credit cards: Visa Premium, MasterCard, Diners, Visa, or Maestro.

b) Payment by general payment slip. Products for which an order has been placed can be paid by payment using a general payment slip in all bank branches, FINA offices, or Croatian Post offices. After confirming the order, Consortium forwards via email the information required for payment by a general payment slip. All information must be correctly entered in the general payment slip, and payment must be made within the deadline.

c) Payment by online banking. Products for which an order has been placed can be paid via online banking of any bank where this payment method is available. After confirming the order, Consortium forwards all necessary information for payment by email.

d) For purchases made by credit or debit card, payment by general payment slip, online banking, or cash on delivery and for a one-time payment, a 5% discount is obtained, which will be calculated on the invoice, and the displayed prices on the webshop will include it.

e) A discount is obtained for products on sale on all payment forms.

f) Discounts are not cumulative with other discounts.


Consortium Ltd. undertakes to respect the anonymity and privacy of users of the Consortium webshop and will use and process data exclusively for the purpose and intention determined by these Terms. Consortium may collect personal data from users, such as name, address, OIB, telephone number, or email address only if the user voluntarily provides them to Consortium.

Consortium will use the provided data solely for the purpose of fulfilling contractual obligations and gaining better insight and understanding of individual needs, habits, and requirements of users, as well as further developing and providing better services by Consortium. Consortium collects, processes, and publishes data on users related to the manner of using the sugarfactory.hr webshop without disclosing the user's identity and/or personal data that would allow revealing the user's identity.
Consortium collects and records data on the IP address (Internet Protocol Address) of users or the location of the computer for the purpose of system administration, resolving malfunctions, confirming the receipt of content, or improving the technical aspects of the Internet service. Consortium will automatically record data on the user's usage habits of Consortium, including among other things, a log file on the visits to certain pages and/or content. Such data will be used by Consortium solely for the purpose of improving its service and adapting and individualizing promotional activities according to the needs of each user.

Consortium does not record your credit card number or store transaction data. Consortium uses the services of a third party, authorized bank, for credit card payment, which protects your data by encryption.

one-time payment by Diners, Discover, DinaCard, Maestro, Mastercard, and Visa cards,
payment in 36 installments by Diners cards of Erste Bank
payment in 12 installments by Maestro and Visa (MB+) cards of Erste Bank
*The minimum amount for installment payment by Maestro and Visa cards is 26,55 €.
